Weevio Cloud PIMS API Terms of Service

Introduction

Welcome to the Weevio Cloud APIs. These APIs are provided to you to integrate and automate your workflows, extend your applications, and harness the power of Weevio Cloud Services. By accessing or using the Weevio Cloud APIs, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

1.1. By accessing or using the Weevio Cloud APIs, you confirm your acceptance of these Terms and your agreement to be a party to this binding contract. If you are accessing or using the APIs on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms.
1.2. If you do not agree to these Terms, you may not access or use the Weevio Cloud APIs.

2. Disclaimer of Warranty

2.1. The Weevio Cloud APIs are provided "as is" and on an "as available" basis, without warranty of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
2.2. MacExperience, Inc. (d.b.a. "Weevio") expressly disclaims any and all warranties and conditions, express or implied, regarding the APIs, their use, or any results to be obtained therefrom. By accessing or using the Weevio Cloud APIs, you acknowledge and agree that you are using them at your own risk.

3. API Use and Restrictions

3.1. Weevio grants you a limited, non-exclusive, non-transferable, and revocable license to use the Weevio Cloud APIs solely in accordance with these Terms and any other guidelines or policies provided by Weevio.
3.2. It is HIGHLY RECOMMENDED that you utilize a PIMS test server environment when testing and integrating with the Weevio Cloud APIs. Direct testing on a live production PIMS server is strongly discouraged to avoid potential disruptions or data loss in your production environment.
3.3. You agree not to misuse the Weevio Cloud APIs or help anyone else do so. Misuse includes any unauthorized use, copying, or distribution of API data, or interfering with or compromising the operation of the APIs.

4. Limitation of Liability

4.1. To the fullest extent permitted by law, Weevio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your access to, use of, or inability to access or use the APIs; (b) any third party conduct or content associated with the APIs, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties.

5. Modification of Terms

5.1. Weevio reserves the right to modify these Terms at any time. You will be notified of any changes through the Weevio Cloud APIs documentation or through other communication channels. By continuing to access or use the APIs after those changes become effective, you agree to be bound by the revised Terms.

6. Termination

6.1. Weevio may terminate your access to all or any part of the APIs at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this agreement, you may simply discontinue using the Weevio Cloud APIs.

7. Governing Law

7.1. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Weevio operates, without regard to its conflict of law provisions.
